About us and these Terms and Conditions

"We" are Bill Bailey Merchandising Limited; a company registered in England with registered number 5727454 with registered offices at OJ Kilkenny & Co, 6 Lansdowne Mews, London, W11 3BH. We are authorised to supply merchandise relating to Bill Bailey. If you have any comments or suggestions, we would be pleased to receive them by e-mail at shop@billbailey.co.uk.

These Terms and Conditions govern the supply by us of any products ordered by you relating to this Web site, whether on the Site or by any other means. The particular product that you order at any one time from us is referred to in these Terms and Conditions as " the Product ". By agreeing to order a Product, you agree to be legally bound by these Terms and Conditions.

Making Orders of Products

When making an order on the Site, you must follow the instructions on the Site as to how to make your order and for making changes to your order before you submit it to us.

If you are asked for details of a payment card, you must be fully entitled to use that card. The card must have sufficient funds to cover the proposed payment to us.

When you submit an order to purchase a Product from us, you agree that you do so subject to these Terms and Conditions.

If you discover that you have made a mistake with your order after you have submitted it to us, please contact shop@billbailey.co.uk immediately.

Delivery of the Product

When we confirm the date of delivery, we are unable to say at what time of day delivery is to take place. If you have specific delivery requirements, please contact us and we will try to do what we reasonably can to help.

On delivery of the Product, you may be required to sign for delivery.

If you are not available to take delivery or collection at the designated time, we may leave a card giving instructions on either redelivery or collection from the depot.

Returning the Product

The following information is additional to and do not affect your statutory rights, under which you have the right to insist that goods that you buy from businesses must correspond with their description, be fit for their purpose and be of a satisfactory quality.

You may return the Product to us for any reason at all if you are not happy with it provided that you do so within 28 days of us having delivered it to you. Returns information is supplied with all orders.

We shall not be obliged to accept returns of any Product which is an item of clothing that has been worn or washed after delivery; nor any audio or video recording, where the seal around it has been broken after delivery.

If you return the Product we will only accept it if you return it to us in its original condition, after which we will refund your payment into the same account from which it was taken.

Faulty Products

The following information does not affect your statutory rights.

In order to resolve the issue of faulty products, we may need your assistance with the provision of certain information regarding the Product.

Circumstances beyond our control

We shall not be liable for any delay, hindrance to us or failure to deliver due to any circumstances outside our reasonable control. However, if you have not received the ordered Product within 28 days, you may cancel your order.

General

We shall keep a record of your order and these Terms and Conditions until six years after we have accepted your order. However, for your future reference, we advise you to print and keep a copy of these Terms and Conditions, your order and any e-mail or written acknowledgement that we make.

If any clause in these Terms and Conditions shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable, this shall in no way affect any other part of these Terms and Conditions.
These Terms & Conditions shall be governed by English law.

Bill Bailey Merchandising are committed to protecting your privacy. We use the information we collect about you to process orders and to provide a more personalised shopping experience. What information do we collect? How do we use it?

When you order, we need to know your name, e-mail address, delivery address, credit or debit card number and the card's expiry date. This allows us to process and fulfil your orders and to notify you of the status of your order. We also ask for your telephone number which enables us to contact you urgently if there is a problem with your order. For some international deliveries this number may be given to our couriers. When you enter a contest or other promotional feature we may ask for your name, address and e-mail address so we can administer the contest and notify winners. We also use the information you provide for assessment and analysis (e.g. market, customer and product analysis) to enable us to review, develop and improve the services which we offer and also to monitor customer traffic patterns and site usage to help us develop the design and layout of the shop. We may also use the information we collect to occasionally notify you by email, telephone (including automated calls, SMS text message and other electronic messages such as picture messaging) and post about important functionality changes to the website and new products and services (including special offers, discounts, offers, competitions and so on) which we think you'll find valuable. How does Bill Bailey Merchandising protect customer information?

When you place an order we use a secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. Furthermore, as required by UK Data Protection Legislation, we follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access. Our security procedures mean that we may occasionally request proof of identity before we are able to disclose sensitive information to you. We endeavour to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data you disclose on-line. You accept the inherent security risks of providing information and dealing on-line over the Internet and will not hold us responsible for any breach of security unless this is due to our negligence or wilful default.

Fraud Prevention

In order to protect our customers and us from fraud and theft, we may pass on information that we obtain from making identity checks and other information in our customer records, including how you conduct your account, to other companies within the group of BBm companies, other retailers and to financial and other organisations (including law enforcement agencies) involved in fraud prevention and detection, to use in the same way.

What about "cookies"?

Cookies are small pieces of information that are stored by your browser on your computer's hard drive. Most Web browsers automatically accept cookies, but you can usually change your browser to prevent that. Currently we do not use cookies to allow us to monitor your shopping, for you to personalise your shop and provide you with recommendations. However, in the future we may well include this functionality.

Will Bill Bailey Merchandising disclose the information it collects to outside parties?

Bill Bailey Merchandising does not sell, trade or rent your personal information to others. Bill Bailey Merchandising may provide aggregate statistics about our customers, sales, traffic patterns and related site information to reputable third-party vendors, but these statistics will include no personally identifying information.
